HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA CONTEMPT CASE No.1654 of 2015 O R D E R : (per Hon'ble Sri Justice R.Subhash Reddy) This Contempt Case, under Sections 10 to 12 of the Contempt of Courts Act, 1971 has been filed alleging willful and deliberate disobedience of the orders passed by this Court in W.P.No.5210 of 2013, dated 01.04.2013.
2. By the aforesaid order, the writ petition was disposed of directing the respondents therein to consider the claim of the petitioner for appointment on compassionate grounds, which was in force.
3. In this contempt case, it is the allegation of the petitioner that inspite of specific directions of this Court, the respondents have not considered her case for appointment on compassionate grounds.
4. In the counter affidavit along with relevant material papers filed on behalf of the respondents, it is stated that as per the orders of this Court, the application of the petitioner for appointment on compassionate grounds was considered and rejected by the Divisional Forest Officer, Eluru, by a speaking order vide proceedings in Rc.No.2144/2010/S3, dated 17.10.2015.
5. The learned Government Pleader for Service appearing for the respondents also submits as the employee i.e., the husband of the petitioner, was not in service as on the date of his death, the claim of the petitioner for appointment on compassionate grounds was rejected.
6. Heard learned counsel for the parties and perused the
material on record.
7. It is true that the respondents have not considered the claim of the petitioner within the time-frame as fixed by this Court vide orders in W.P.No.5210 of 2013, dated 01.04.2013. However, in view of the fact that an order has already been passed by the respondents rejecting the claim of the petitioner for appointment on compassionate grounds, it is not a fit case to proceed further in this contempt case. If the petitioner is aggrieved by the said order of rejection, she can question the same in appropriate proceedings.
8. Accordingly, this contempt case is closed. No order as to costs.
