HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 7 3 5 8 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Sub-Inspector of Police, Naspur Police Station, Mancherial District, dated 30.10.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "The petitioner herein has sent a petition dated 09.10.2018 to this respondent Police Station of Naspur Police Station, Mancherial District, through post stating that his father was having patta land in Sy.No.93/ 11, measuring Ac.0.32 gts.
, situated at Seetarampally village, Naspur Mandal and after his death, in the yar 2012, the said land was mutated on the name of his mother Aggu Rajamma and to usurp the above said land in illegal means, the persons by name Dharani Rajalinga, Dharani Shankaraiah, Dharani Venkatesham and Tahsildar Kishan, have created false documents and the Tahsildar Suresh implemented these documents in wrongful manner by removing their names from revenue records and they have filed an application before the RDO these documents were submitted by the above named persons and further stated that the patta which was standing on the name of his father and which was mutated on the name of his mother is not cancelled till date and even then the above named persons created fake and forged proceedings bearing No.
ROR/ IA/ Seetarampally/ 75/ 20 and B/ 2622/ 2013, and used the said documents to knock away his land in illegal ways and that though he has intimated the matter to the RDO and the Tahsildar, no injustice was done to him and hence requested the police to take necessary action, as per law.
Upon receipt of the said petition through post, an entry was made into the Station General Diary, after enquiry will be taken.
In the preliminary enquiry, it is revealed that against the Orders of the MRO regarding the subject issue, the petitioner filed an appeal before the RDO, Mancherial, vide File No.G/ 114/ 2017, dated 28.07.2018 and the RDO also dismissed the appeal filed by the petitioner herein.
Since the dispute of the petitioner herein is purely civil in nature and hence, this respondent police advised him to seek his redressal in a competent Court of law. To that effect, notice dated ..10.2018 was also issued to the petitioner herein.
A copy of the notice issued to the petitioner herein is annexed to this written instructions for the kind perusal of this Hon'ble Court.
I humbly submit that since the dispute of the petitioner herein as well as the unofficial respondents herein is purely civil in nature and the appeal filed by the petitioner herein was also dismissed by the RDO, Mancherial regarding the subject lands in question and hence no action was taken on the complaint of the petitioner herein except advising him to approach the competent Court of law."
Having regard to the contents of the above instructions, the Writ Petition stands disposed of, keeping it open for the petitioner herein to avail the other remedies, in accordance with law.
