HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL PETITION No.379 of 2015 ORDER:

The petitioner, who is accused No.1, filed the present application under Section 438 Cr.P.C. seeking release in the event of his arrest in connection with Crime No.69 of 2013 of Balaji Nagar Police Station, Nellore, registered for the offences punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961.

At the time when the matter is taken up for hearing, the learned Public Prosecutor submits that police have already investigated into the matter and filed the charge sheet which was taken on file as C.C.No.513 of 2013 on the file of the V Additional Judicial Magistrate of First Class, Nellore and non-bailable warrant was issued against the petitioner/accused No.1 on 07.11.2013. The material on record further discloses that accused No.1, who is the petitioner herein, is not in India.

Having regard to the said circumstances and since the material on record discloses about the divorce obtained in the month of May, 2014 and re-marriage of the informant on 15.08.2014, the petitioner herein is directed to appear before the concerned Court within one month from today and move an application for recall of the nonbailable warrant issued against him on 07.11.2013, in which event the same shall be dealt with on the same day on terms and conditions which that Court deems fit and proper.
