HON'BLE SRI JUSTICE R.SUBHASH REDDY AND HON'BLE SRI JUSTICE A.SHANKAR NARAYANA WRIT PETITION No.33712 of 2015 ORDER : (Per Hon'ble Sri Justice R.Subhash Reddy) In this writ petition, the petitioner has questioned the e-auction sale notice dated 05.09.2015, fixing the date of auction as 24.09.2015 under the provisions of the SARFAESI Act. When the matter is called for hearing, it is submitted that sale is not materialized pursuant to e-auction notice dated 05.09.2015, as such, the subject matter of the writ petition has become infructuous. In view of the same, the Writ Petition is dismissed as infructuous. However if the petitioner has filed any representation for One Time Settlement, it is open to the respondent Bank to consider the same in accordance with the provisions of such Scheme. As a sequel, pending miscellaneous petitions, if any, shall stand closed.
