Chowdappa, v. The State Of Andhra Pradesh,
HON'BLE SRI JUSTICE R.KANTHA RAO W.P.No.25863 of 2015
ORDER
This Writ Petition is filed seeking to declare the action of the respondents in preventing the petitioner from discharging duties as Field Assistant, Kalluru Village, Lepakshi Mandal, Anantapur District, as arbitrary and illegal. While the petitioner was working as Field Assistant of Kalluru Village, Lepakshi Mandal, Anantapur District, a case in Cr.No.121 of 2014 for the offence punishable under Section 302 read with 34 was registered against him. In pursuance thereof, he was arrested and subsequently enlarged on bail. However, as the respondents are not allowing him to discharge the duties, the petitioner made representations dated 20.12.2014 & 14.05.2015 to the 4th respondent- Project Director-cum-Joint Secretary. The 5th respondent-Mandal Parishad Development Officer also addressed a letter dated 15.05.2015 to the 4th respondent to consider the case of the petitioner for reinstatement. But, so far no action has been taken.
The grievance of the petitioner is that he was falsely implicated in the said case and so far no
action has been taken on the representations submitted by him in spite of the letter addressed by the 5th respondent.
In view of the same, the Writ Petition is disposed of directing the 4th respondent-Project Director-Cum-Joint Secretary to take appropriate action on the representations submitted by the petitioner keeping in view the letter dated 15.05.2015 addressed by the 5th respondent within a period of four weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
Miscellaneous petitions pending, if any, shall stand closed.
