THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.13214 of 2012 ORDER:

The complaint of the petitioner in the present writ petition is the action of the respondents in dispossessing him under the guise of laying the road through his house site situated in Survey No.532 of Piler Village and Mandal, Chittoor District. A counter-affidavit, deposed by the Deputy Executive Engineer, PRI Sub-Division, Piler, is filed stating that the petitioner objected for laying the C.C. road in his house site and the work was stopped and no damage was caused; that however, after convincing the petitioner and his legal heirs by the public of the Village, the respondents have agreed to lay the C.C. road in the petitioner's house site and accordingly, the C.C. road was laid and it was brought to traffic-worthy for the public.

In view of the above averments, the writ petition is closed, however, with liberty to the petitioner to claim compensation if he is entitled to do so. There shall be no order as to costs. Consequently, Miscellaneous Petitions, if any pending in this writ petition shall stand disposed of.
