THE HON'BLE SRI JUSTICE RAJA ELANGO Tr. Criminal Petition No.198 of 2015 ORDER:

This Transfer Criminal Petition is filed under Section 407 Cr.P.C. seeking of transfer of C.C.No.280 of 2014 pending on the file of Additional Judicial First Class Magistrate, Ramachandrapuram to any other Court other than the Courts at Ramachandrapuram, Alamuru, Anaparthy and Kakinada in the interest of justice.

Heard the learned counsel for the petitioner and the learned counsel for the respondents 1 and 2.

At the time of arguments for some time, both the counsel fairly conceded that the case may be transferred to any other Court other than the Courts at Ramachandrapuram in the interest of justice.

Considering the facts and circumstances of the case and taking into consideration the request of the parties, C.C.No.280 of 2014 pending on the file of Additional Judicial First Class Magistrate, Ramachandrapuram is withdrawn from that Court and transfer the said case to the Court I Additional Judicial First Class Magistrate, Rajahmundry and the learned Magistrate to whom the case is transferred is directed to dispose of the said case as expeditiously as possible, preferably within a period of six months from the date of receipt of the said case. Till the said case is transferred, the presence of the respondents is dispensed with except on the dates when their presence is essentially required by the Court.

Accordingly, the transfer Criminal Petition is allowed Consequently, miscellaneous petitions pending, if any, shall stand closed.
