THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 22719 of 2015 O R D E R :

This Writ Petition is filed to declare registration of FIR No. 193 of 2015 on the file of Bowenpalli Police Station, Hyderabad, dated 29.05.2015 against the petitioners, as illegal and arbitrary. This Court, while admitting the Writ Petition on 22.07.2015, granted interim stay of further proceedings in the above said crime, including arrest of the petitioners.

It is submitted by learned Assistant Government Pleader for Home that after due investigation, a final report was filed before the Hon'ble XI Additional Metropolitan Magistrate's Court at Secunderabad, referring the complaint as 'civil in nature', a copy of which has also been made available to the petitioners. Learned counsel for the 3rd respondent asserts that no notice was given to his client as to filing of the final report, hence, he prays liberty may be given to him to take appropriate steps with respect to the said report .

Having regard to the respective submissions, since the final report was filed referring the dispute as civil in nature, no purpose would be served in keeping the Writ Petition pending. Accordingly, the Writ Petition is closed, however, with liberty to the 3rd respondent to assert his rights in accordance with law. No costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
