HON'BLE SRI JUSTICE R.KANTHA RAO W.P.No.28671 of 2015 ORDER:

Heard learned counsel on either side.

The petitioner was appointed as Field Assistant in 2009. While so, on the allegation of misappropriation of funds, he was kept under suspension v i d e impugned proceedings dated 26.08.2015.

Learned counsel appearing for the petitioner submits that the petitioner has nothing to do with the misappropriation of funds and he was unnecessarily kept under suspension. On the other hand, learned Special Counsel appearing for the respondents would submit that the order impugned is an order pending enquiry and therefore, it needs no interference. Since the order impugned is an order of suspension pending enquiry, I am not inclined to examine the merits of the case.

Therefore, the Writ Petition is disposed of directing the 2nd respondent-Project Director to complete the enquiry and pass final order in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order, failing which the order impugned shall stand revoked. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
