Smt. Nallavolu Pushpamma v. The State Of Telangana
THE HON'BLE SRI JUSTICE RAJA ELANGO Crl.P.No.3575 of 2016
ORDER
This petition under Section 482 Cr.P.C. is filed by the petitioner/accused seeking to quash the proceedings in S.C.No.99 of 2015 on the file of the Special Judge for SCs & STs (POA) Act, Ranga Reddy District at L.B.Nagar, for the offence punishable under Section 3(1)(x) of SCs & STs (POA) Act, 1989, against her.
2. It is alleged in the charge sheet that on 17.11.2014, while the de facto complaint along with her husband was proceeding to ration shop and on the way while they were discussing about the death of Rajamma's grand son which occurred on 16.11.2014, the petitioner/accused abused the de facto complainant in filthy language in the name of her caste due to previous disputes and also tried to beat her with chappals. Based on the complaint, a case in Cr.No.263 of 2014 was registered against the accused for the aforesaid offence. 3.
Learned counsel for the petitioner submits that due to civil disputes between the petitioner and the de facto complainant, a false case has been foisted against the petitioner and that there is a delay in lodging the complaint and therefore, the proceedings against the petitioner may be quashed.
4. The points raised by the learned counsel for the petitioner have to be decided by a competent Court after full fledged trial and truth or otherwise of the allegations made against the petitioner cannot be decided at this stage. Therefore, this Court is not inclined to interfere with the impugned proceedings. Hence, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this criminal
petition shall stand dismissed.
