HON'BLE SRI JUSTICE R. KANTHA RAO Writ Petition No.18512 of 2015 ORDER:

Heard the learned counsel appearing for the petitioner, the learned Government Pleader for Panchayat Raj & Rural Development and Sri M.S.Ramachandra Murthy, learned special for MGNREG Scheme.

2. According to the petitioner, he was appointed as Field Assistant in Lakkimdiddi Village, Kotabommali Mandal, Srikakulam District, by the 5th respondent under National Rural Employment Guarantee scheme. On four charges alleging that the petitioner has not been discharging functions properly, a show cause notice was issued and the petitioner submitted his explanation and thereafter, the 3rd respondent issued proceedings dated 27.03.2015 removing the petitioner from his job. Challenging the said proceedings, the present writ petition is filed.

3. It is submitted by the learned counsel appearing for the petitioner that the charges framed against the petitioner are not specific and they are vague and without conducting any enquiry, the petitioner shall not be removed from his job. On the other hand, learned special counsel for MGNREG Scheme submits that the petitioner preferred an appeal to the 2nd respondent-District Collector, which is now pending.

4. Under these circumstances, without going into the merits of the case, the writ petition is disposed of directing the 2nd respondentAppellate Authority, to dispose of the appeal filed by the petitioner, within a period of eight (8) weeks from the date of receipt of a copy of this order. Miscellaneous applications, if any, in this writ petition, shall stand closed. No order as to costs.
