THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.9788 of 2013 ORDER:

The petitioner complains against inaction of 2nd respondent in looking into the complaint dated 21-02-2013 as illegal and arbitrary.

The Assistant Government Pleader, on instructions, submits that there is no acknowledgment of receiving the complaint by 2nd respondent, if a complaint is presented, the 2nd respondent would not have refused.

I have perused the material papers filed along with the writ petition.

Prima facie, I am satisfied that the petitioner has not placed the acknowledgment of receiving complaint dated 21-02-2013. Unless and until such acknowledgment is filed on record, the inaction complained against respondents c annot be considered.

The writ petition fails and is accordingly dismissed. No order as to costs.
