THE HONOURABLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.44330 of 2016 ORDER:

This writ petition under Article 226 of Constitution of India is filed seeking a writ of mandamus declaring the action of the 2nd respondent in not considering the application of the petitioner dated 27.8.2016 for shifting of the New Venkateshwara Medical Shop from the existing premises to the new premises at Komati Street, Santhakaviti village & Mandal, Srikakulam District as arbitrary and illegal, and consequently, direct the 2nd respondent to accord permission for shifting of the shop of the petitioner.

The only grievance of the petitioner is that after completion of construction of a shop in his own site, he made an application through Area Drugs Inspector to the 2nd respondent seeking permission for change of shop premises on 27.8.2016, but so far, no permission is accorded.

Considering the grievance of the petitioner, the petitioner is directed to make a fresh representation to the 2nd respondent on or before 05.01.2017 informing his intention to change his medical shop from the existing premises to the new place. On such representation, the 2nd respondent is directed to consider and pass appropriate orders within a period of one month from the date of filing of representation by the petitioner.

Accordingly, the writ petition is disposed of. No costs. Pending Miscellaneous Petitions, if any, shall stand closed. _________________ RAJA ELANGO,J 20.12.2016.
