HON'BLE SRI JUSTI CE A.V.SESHA SAI W .P.No.3 7 6 5 0 of 2 0 1 8 ORDER: - When the matter is taken up, the written instructions furnished by the Station House Officer, Balanagar P.S., Cyberabad, dated 12.10.2018, are placed on record by the learned Government Pleader. The said instructions read as under: - "It is submitted that the 5th respondent i.e., Md.Atheeq has given a petition dated 07.10.2018 with Balangar P.S., Cyberabad, stating that he has purchased Varna Fludic 2012 Model Car No.AP 13 AC 9224 from TVS Finance, Begumpet, and paying EMI of Rs.13,500/ - p.m. While so, at the request of his friend Anwar Pasha, he has given his car to him. The said Anwar used to do business in self driving cars. Though a few days have elapsed, his friend did not return him the car taken from him. On enquiry, he came to know that his friend handed over his car to one Mr.Khaled Bin Syed of Chandrayanagutta. When he contacted the said Khaled Bin Syed, he informed that he has purchased the car from Anwar Pasha. Hence, requested to take necessary action in the matter.

It is submitted that the above petition was entered in the Station records vide Petition ID: CYB/ BNR_CYB/ 071018/ 00742, dated 07.10.2018 and conducted petition enquiry. The enquiry with the petitioner revealed that the subject matter is purely civil in nature and it involves purchase of vehicle by the complainant and taking loan from the petitioner duly depositing the vehicle documents. In the said circumstances, no further action was taken

on the petition given by the 5th respondent and he was advised to approached the concerned Civil Court in the matter.

It is submitted that the Balanagar Polie except conducting petition enquiry based on the petition given by the 5th respondent, did not interfere in civil disputes between the petitioner and the 5th respondent and also not directed the petitioner to return the vehicle to the 5th respondent."

On noticing the same, a request is made by the learned Counsel further petitioner to place the above instructions on record and dispose of the Writ Petition.

Accordingly, the Writ Petition is disposed of, by placing on record the said instructions furnished by the Station House Officer, Balanagar P.S., Cyberabad, dated 12.10.2018.
