HON'BLE SRI JUSTICE U.DURGA PRASAD RAO CRIMINAL PETITION No.11921 of 2013 ORDER:

This Criminal Petition is filed under section 482 of Cr.P.C. by the petitioners/respondent nos. 2 and 3 seeking to quash proceedings in D.V.C.No.177 of 2013 on the file of IV Metropolitan Magistrate, Hyderabad.

When the matter came up for hearing, learned counsel for the petitioners would submit that petitioner no.2/respondent no.3 died during pendency of this petition. He would further submit that insofar as petitioner no.1/respondent no.2 is concerned, he is not insisting for quashment of proceedings, but having regard to his old age, his appearance before the trial Court may be dispensed with. In view of the judgment in Giduthuri Kesari Kumar v. State of Telangana1, the request of the petitioner no.1 is considered.

In the result, the Criminal Petition is dismissed as abated insofar as petitioner no.2/respondent no.3 is concerned and the Criminal Petition is disposed of insofar as petitioner no.1/respondent no.2 is concerned and the presence of petitioner no.1/respondent no.2 before the trial Court is dispensed with except on the occasions when trial Court requires his attendance. 1 2015(2) ALD (Crl.) 470 (AP)

As a sequel to disposal of the case, pending miscellaneous petitions, if any, shall stand closed.
