HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.10406 of 2015 ORDER:

This petition is filed for issuance of a writ of Mandamus declaring the action of respondents 1 to 3 in not taking any action, pursuant to the representations dated 26.03.2015 and 30.03.2015 of the petitioner against the 4th respondent, who is making illegal construction contrary to building permission, layout rules and without having setbacks and consequently to direct the respondents 1 to 3 to demolish the illegal construction. 2.The case of the petitioner is that the 4th respondent, who is his adjacent owner, is illegally constructing a building consisting of three floors within 90 Sq.yards without leaving any set backs and without any sanction plan from the 1st respondent. Though, the petitioner made representations on 26.03.2015 and 30.03.2015 to the respondent-Authorities, no action has been taken so far. Aggrieved by the same, the present writ petition is filed.

3. Heard the learned counsel for the petitioner and Sri R.Radha Krishna Reddy, learned Standing Counsel appearing for respondents 1 to 3.

The learned Standing Counsel for respondents 1 to 3 by placing a copy of the instructions received by him, on record submits that a notice, under Section 452(1) and 461(1) of the Greater Hyderabad Municipal Corporation Act, 1955 was issued to the 4th respondent on 06.04.2015 with regard to unauthorized construction of second floor and pent house and the respondent-Authorities would take appropriate action in accordance with law.

5. In view of the above said submissions, this Writ Petition is disposed of directing the respondents 1 to 3 to take further action in accordance with law. No costs. Miscellaneous petitions, pending if any, shall stand closed. ____________________ A.RAJASHEKER REDDY, J Date: 20-04-2015
