THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.42727 of 2015 ORDER :

Heard counsel for the petitioner and the Government Pleader for Civil Supplies appearing for respondents.

2. In this Writ Petition, petitioner has questioned proceedings dt.17.12.2015 of the 2nd respondent suspending the Fair Price Shop Dealership authorization of the petitioner.

3. Although counsel for the petitioner contends that the petitioner has not committed any irregularity as mentioned therein, I am of the opinion that it is a matter for enquiry.

4. Since the impugned proceedings itself invites an explanation from the petitioner for the irregularities mentioned therein, it is to be construed as a show cause notice-cum-order of suspension.

5. Therefore, the 2nd respondent is directed to receive the explanation of the petitioner in response to the impugned proceedings; conduct enquiry in accordance with Sub-Clause (5) of Clause (5) of A.P. State Public Distribution System (Control) Order, 2008 after giving a personal hearing to the petitioner; and then pass appropriate orders thereon in accordance with law, on or before 18.03.2016.

6. The Writ Petition is disposed of with the above direction. There shall be no order as to costs.

7. Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
