HON'BLE SRI JUSTICE S. RAVI KUMAR Tr.CIVIL MISCELLANEOUS PETITION No.265 of 2016 ORDER:

This petition is filed to withdraw O.P.No.9 of 2014 from the file of Family Court-cum-IV Additional District Judge, Kurnool and transfer the same to Judge, Family Court, Ranga Reddy.

2. Wife filed this petition. According to her affidavit, her marriage with respondent was performed on 29.05.2006 at Guntakal, Ananthapur District and that they set up matrimonial home at Hyderabad and lived for about 23 days and thereafter, respondent started harassing her and now she is staying at Hyderabad at his brother's house. She stated that respondent filed O.P before Family Court, Kurnool for divorce and with great difficulty, petitioner is attending Kurnool from Hyderabad, but now she is not able to attend Family Court at Kurnool, as she is living on the mercy of her brother. Hence, she prayed for transfer of OP from Family Court, Kurnool to Family Court, Ranga Reddy.

3. This Court permitted petitioner to take out personal notice to respondent through registered post with acknowledgment due. In compliance of the said order, advocate for petitioner filed memo stating that notice sent to respondent was returned with an endorsement 'not claimed' and the same amounts to service of notice. Respondent neither appeared in person nor through any advocate.

4. Heard arguments. Perused affidavit filed in support of petition.

5. Considering the reasons stated in the affidavit filed in support of petition and also considering convenience of wife, O.P.No.9 of 2014 is withdrawn from the file of Family Court-cum-IV Additional District Judge, Kurnool and transferred to Judge, Family Court, Ranga Reddy,

for disposal in accordance with law.

6. Accordingly, the Transfer Miscellaneous Petition is ordered. No costs. As a sequel, miscellaneous petitions, if any filed in this civil miscellaneous petition, shall stand closed.
