HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 38067 of 2018 ORDER:

1) Heard.

2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.2 in not allowing the petitioners to make construction as per the sanctioned permission vide proceedings in File No.3072/W2/2017/0575, dated 11.05.2017, for construction of the RCC building in the property bearing Mpl.No.2-8-69 (old No.2-8-758, 2-7-664), situated at Weekly Bazar, Nizamabad, admeasuring 78.94 square yards or 66.00 square meters, inspite of petitioners' reply dated 8-8-2018 to the show cause notice issued under Section 450 of GHMC Act, 1955, by respondent No.2, vide notice dated 07.08.2018, as illegal and arbitrary.

3) At the time when the matter is taken up for hearing, learned Standing Counsel for Municipal Corporation placed on record the proceedings No. 3072/W2/2017/0575, dated 18.08.2018, wherein building permission granted to the petitioners was revoked under Section 450 of the Hyderabad Municipal Corporation Act, 1955.

4) Having regard to the above, the writ petition is closed giving liberty to the petitioners to avail the remedies available under law.
