WRIT PETITION No.28862 of 2015 ORDER :

Heard learned counsel for petitioners and learned Government Pleader for R.1 and R.3 and Sri G.Seshadri Naidu, learned Standing counsel for the Respondent No. 4 and with their consent, the writ petition is taken up for disposal at the admission stage.

2. The petitioners are the resident of Vontimitta Gram Panchayat. The 5th respondent was elected as Sarpanch of The Gram Panchayat, Vontimitta-4th respondent, about two years back and since then the 5th respondent has not conducted any Managing Committee meetings and general body meetings and taking decisions at the instance of the 6th respondent who is the brother-in-law of the 5th respondent and issuing cheques without the consent of the Managing Committee members and misusing the funds of Gram panchayat. It is also alleged that the 5th respondent has issued No Objection Certificate to one Ice factory which is situated at Narvakatapalle Gram panchayat which is not in the jurisdiction of the 4th respondent Gram Panchayat and that the 6th respondent is also signing th e cheques in the name of 5th respondent.

Alleging all the illegalities committed by the 5th and 6th respondents, a representation was submitted on 06.07.2015. But so far no action is taken. As no action is taken by the 3rd respondent the petitioners have submitted another representation to the District Collector, YSR Kadapa District-2nd respondent on 03.08.2015. Alleging no action is taken by the respondent-authorities, this writ petition is filed.

3. When the matter is taken up, both counsel agreed for disposal of the writ petition with a direction to the respondent authorities to expeditiously dispose of the representations dated 06.07.2015 and 03.08.2015 submitted by the petitioners.

4. Having regard to the same, without expressing any opinion on the merits of the matter, writ petition is disposed of directing the respondent authorities to consider the representations of the petitioners dated 06.07.2015 and 03.08.2015 and pass appropriate orders as warranted under law, within a period of four weeks from the date of receipt of copy of this order, after putting

on notice the respondents 5 and 6 and after affording due opportunity of hearing and communicate the decision to the petitioners. No costs. Having regard to the same, miscellaneous petitions, if any pending, are closed. __________________ P.NAVEEN RAO,J 8th September, 2015.
