THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.17799 OF 2013 ORDER:

The writ petition is filed seeking a writ of mandamus declaring the action of the third respondent in opening and continuing the rowdy sheet vide Rowdy Sheet No.5 on the file of the third respondent against the petitioner as illegal and arbitrary, and consequently to quash the same. Heard and perused the material.

Learned counsel for the petitioner submits that the petitioner was falsely implicated in one crime in 2001 and that subsequently, the petitioner was acquitted. The third respondent is insisting the petitioner to come to the police station regularly. He further submits that though the acquittal of the petitioner is informed to the third respondent on number of occasions, the third respondent is continuing the rowdy sheet against the petitioner, which is illegal and arbitrary, and as such, learned counsel prays this Court to direct the respondents 2 and 3 to close the rowdy sheet against the petitioner.

Considering the facts and circumstances of the case, the petitioner is directed to make a representation to the respondents 2 and 3 stating that he is not involved in any other crimes apart from the crime mentioned above and on filing of such application, the respondents 2 and 3 are directed to consider the representation and pass appropriate orders. Further, the respondents 2 and 3 are directed not to compel the petitioner to come to the Police Station. The writ petition is accordingly disposed of.
