Heard.

The present writ petition is filed declaring the action of respondents 3 and 4 in dispossessing the petitioners from the land admeasuring Ac.Ac.0-05 1⁄2 cents or 0022 hector or 266-2 sq. yards or 222.578 sq. mtrs. in Sy.No.395/1 situated at Balaga, Bondalipuram, Srikakulam Town and District, without issuing any notice and without following the due procedure as illegal and arbitrary. Learned Government Pleader on instructions states that the respondents are informed that the land in Sy.No.395/1, wherein the petitioner claims ownership of a part of land is a patta land. However, Sy.No.400 of the same village is a Government land and the objection of the respondents is only with regard to Sy.No.400. Since the petitioners' claim in the writ petition is confined to Sy.No.395/1 at Balaga, Bondalipuram, Srikakulam Town and District, the writ petition is disposed of directing the respondents not to interfere with the land of the petitioner in Sy.No.395/1 except in accordance with law, after giving notice and opportunity to the petitioner. No order as to costs.
