Heard. With the consent of learned counsel for the parties, the Writ Petition is disposed of at the stage of admission. 2.

The petitioner, a Cooperative Society, responded to the tender notifications in ET No.48/2016-17, for item No.1, and ET No.16/2016-17 for Item Nos.1 to 5, 11 and 14. According to the petitioner, though it has requisite qualifications and certificates, the respondents are not declaring it as successful bidder in so far as Item No.1 of tender notification in ET No.48/2016-17 is concerned and the bids are also not opened. Aggrieved thereby, this Writ Petition is filed.

When the matter is taken up for consideration, learned Standing Counsel for the respondent - Corporation invites the attention of this Court to the terms of the tender notification. According to the same, the validity of the bid period is 90 days from the date of closing of the bid i.e. 23.06.2016, which has already expired, and this Writ Petition is filed after the expiry of validity period.

In view of the fact that the bid validity period has already expired, this Court is not inclined to go into the merits and no direction can be granted to the petitioner.

The Writ Petition is accordingly dismissed. However, the petitioner is at liberty to participate, if the bids are opened. There shall be no order as to costs.

Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
