THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 20070 of 2016 ORDER :

The present Writ Petition came to be filed seeking the following prayer:

"... to issue an appropriate Writ, Order, or Direction, more particularly one in the nature of Writ of Mandamus declaring the action of the Respondents 4 & 5 in telephoning the Writ Petitioner and orally asking him to come to Pochampally Police Station and settle his Civil dispute with Respondent No.6, as illegal, arbitrary and highhanded and pass..."

2. Heard the learned counsel for the petitioner and the Assistant Government Pleader for Home for the State of Telangana appearing for respondents 1 to 5. At the request of both the counsel, the Writ Petition itself is taken up for disposal at the stage of admission. Since this Court is not deciding the case on merits, it may not be necessary to hear respondent No.6.

3. Though various grounds are urged in the Writ Petition, learned counsel for the petitioner seeks a direction to respondents 1 to 5 not to summon the petitioner to police station without following due process of law. It is the case of the petitioner that though the petitioner is not an accused in any case, he is being summoned to police station. The learned Assistant Government Pleader for Home disputes the same and

states that any action taken by police is as per the procedure. Having regard to the same, the respondents 1 to 5 are directed not to summon the petitioner to police station without following due process of law.

4. The Writ Petition is disposed of with the aforesaid direction. Miscellaneous petitions pending, if any, in the Writ Petition shall stand closed in the light of this final order. No order as to costs.
