HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 37876 of 2018 ORDER:
1) Heard learned counsel for the petitioner and learned Government Pleader for Municipal Administration and Urban Development.
2) The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of respondent No.2 in trying to mutate the name of respondent No.3 in respect of the house bearing D.No.3-1130 and vacant site situated in YMR Colony, Prodattur town and mandal, YSR Kadapa District, inspite of pendency of a suit between the petitioner and unofficial respondent, as illegal and arbitrary.
3) The grievance of the petitioner is that though O.S.No.71 of 2018 is filed by the unofficial respondent seeking declaration of right, title of the plaintiff over the property, and inspite of giving notice to the respondents, informing about the pendency of a civil suit, he apprehends that respondents may proceed to mutate the name of unofficial respondent.
4) Learned Government Pleader for revenue would submit that till date no mutation is done and that it is only an
apprehension that the name of the unofficial respondent would be mutated.
5) Be that as it may, without going into merits of the case, the writ petition is disposed of directing the authorities concerned to take into consideration the objections raised by the petitioner and also hear the petitioner before passing any orders, on the application for mutation, if any, made by the respondents and pass orders, in accordance with law, if not already mutated.
