HON'BLE SRI JUSTICE A. RAMALINGESWARA RAO Writ Petition No. 19982 of 2016 Order:

Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondents-TSRTC.

2. The petitioner belongs to Scheduled Tribe (Lambada) Community. He was appointed as a Cleaner on 11.11.1994 in Devarakonda Depot. He passed Intermediate and had ITI qualification. The petitioner was promoted as Mechanic on 04.04.2007. If he renders 2 years of continuous service as Mechanic he is entitled for promotion to the post of Leading Hand/Technical ADC. Thus, he was qualified to be considered for promotion in the year 2011. The rule of reservation was made applicable by virtue of Circular dated 16.04.2003 as modified by another Circular dated 28.06.2004. In order to consider his case he submitted a representation to the Regional Manager, Nalgonda Region, second respondent on 02.02.2016 and when the same was not considered and when no orders were passed, the present Writ Petition is filed.

3. In view of the nature of relief sought for in the present Writ Petition, this Court is inclined to dispose of the Writ Petition at the admission stage itself after ascertaining from the learned Standing Counsel for the respondents with regard to pendency of representation.

4. In the circumstances, the Writ Petition is disposed of directing the second respondent to consider the representation of the petitioner dated 02.02.2016 and pass appropriate orders thereon in accordance with law within a period of three (3) months from the date of receipt of a copy of this order. There shall be no order as to costs.

5. As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition shall stand closed. ________________________ A.
