THE HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.16280 OF 2016 ORDER:

This Criminal Petition, under Section 482 read with Section 457 Cr.P.C. is filed to pass an order directing the Station House Officer, Narsampet Prohibition & Excise Station, Warnagal District, to release the Lorry bearing No.AP-13-X-3200 seized in C.O.R.No.523 of 2016 on furnishing third party security before the Judicial Magistrate of First Class, Narsampet. During hearing, learned counsel for the petitioner submits that the petitioner may be given liberty to file an application before the Deputy Commissioner, Prohibition & Excise, for release of the vehicle and seeks a direction to the said authority to consider the application.

Acceding the request of the counsel for the petitioner, I deem it appropriate to permit the petitioner to file an application before the Deputy Commissioner, Prohibition & Excise, for release of the vehicle, in view of new provisions of A.P. Prohibition and Excise Act and on filing such application, the said authority is directed to decide the application, within ten (10) days from the date of filing application, in accordance with law.

Accordingly, the criminal petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
