THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.34096 of 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondent authorities in not paying the rent to the hostel building premises of the petitioner bearing D.No.7-2-29/4, 5 situated at 26th ward, Ramachandrapuram Mandal, East Godavari District and threatening the petitioner to vacate/evict from the same without paying the rent from August 2015 to till date and without following due process of law and violating the oral agreement, as illegal, arbitrary and contrary to law, and consequently to direct the respondent authorities to pay the rent of the premises of the petitioner and also not to vacate/evict from the same.

Heard and perused the material.

Learned counsel for the petitioner submits that the R.C.C.building of the petitioner was leased out to the B.C.Welfare Department for the purpose of conducting the Government B.C.College Boys Hostel, Ramachandrapuram, for a period of five years, i.e., from August, 2015 to July, 2020 and that the respondent authorities failed to pay rents from the occupation itself, i.e., from August 2015. Learned counsel for the seventh respondent submits that the seventh respondent has already released the funds for the purpose of payment of rent on 10.06.2016 and 11.08.2016. Learned counsel for the petitioner could not able to substantiate whether the said amounts were received by the petitioner or not. Considering the facts and circumstances of the case, the petitioner is directed to approach the concerned authority for payment of rents, which is alleged to have been released in favour of the

petitioner. If there is any failure on the part of the seventh respondent to pay the rent, the petitioner is at liberty to approach appropriate forum for appropriate relief.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 21.10.2016 pln
