THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.37673 OF 2018 ORDER :

Heard learned counsel for the petitioners and the learned Government Pleader for Home, apart from perusing the entire material on record.

When the matter is taken up, written instructions, dated 1310.2018, furnished by the Sub Inspector of Police, Chilkalguda Police Station, Secunderabad, are placed on record by the learned Government Pleader. The said instructions, to the extent of their relevance to the present Writ Petition, read as under: "It is submitted that the property of the petitioners are under civil dispute in O.S.No.445/2013, and A.S.Nos.12 and 13 of 2016 before the Hon'ble Civil Court and the Hon'ble Civil Court did not pass specific orders for providing police aid to the disputed land of the petitioners.

It is further submitted that on the complaint of the 2nd petitioner G.Manohar Singh, a case was registered in Cr.No.182/2018, dated 01.09.2018 for the offences U/s 447, 506 IPC against one P.Sai Reddy and Srinivas Yadav on the file of 3rd respondent-Station House Officer, Chilkalguda Police Station, Secunderabad and the investigation is under progress. It is submitted that the petitioners instead of obtaining police aid orders from the civil Court, filed the present Writ Petition, directing the police to provide protection to the disputed land.

It is submitted that the contentions of the petitioner against the respondents 2 and 3 are incorrect and baseless. The writ petition is devoid of merits and liable to be dismissed". By placing on record the above written instructions, Writ Petition is disposed of, with a further direction to the respondents to complete the investigation and file a final report, strictly in accordance with law, as expeditiously as possible. There shall be no order as to costs.
