HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No.746 of 2014 ORDER:

The present Criminal Revision Case is filed under Sections 397 and 401 of Cr.P.C. challenging the order dated 14.02.2014 passed in Crl.M.P.No.978 of 2013 in M.C.No.88 of 2012 on the file of the Additional Metropolitan Sessions Judge for the trial of JHCBBC-cum-Additional Family Court-cum-XXIII Additional Chief Judge, Hyderabad, wherein and whereunder the trial Court granted interim maintenance of Rs.6,000/- per month to the second respondent herein.

A perusal of the material on record would show that the second respondent herein, who is the wife of the petitioner, filed an application under Section 125 (1) Cr.P.C. claiming monthly maintenance of Rs.15,000/-. By an order dated 14.02.2014, the learned trial Judge awarded interim maintenance at Rs.6,000/- per month to the second respondent herein. Challenging the same the present revision is filed.

On 10.04.2014 this Court while admitting the revision directed the petitioner to pay half of the amount awarded by the trial Court on or before 15th of every month commencing from April, 2014 and on further condition that the petitioner shall pay arrears calculated at the same rate within six weeks from that day.

Though various grounds are raised in the revision learned counsel for both sides, have agreed for disposal of the revision by fixing time limit for disposal of the main maintenance case and

also with regard to payment of monthly maintenance. It is to be noted that while the counsel for the petitioner states that entire arrears as ordered by this Court on 10.04.2014 are deposited within six weeks but the counsel for the second respondent disputes the same. If the order passed by this Court on 10.04.2014 is complied with, the petitioner shall continue to pay maintenance @ Rs.3,000/- per month till the disposal of the maintenance case. If the order dated 10.04.2014 is not complied with, the petitioner shall continue to pay maintenance @ Rs.6,000/- per month as ordered by the trial Court in M.P.No.978 of 2013.

Having regard to the fact that the M.C. is of the year 2012, the trial Court is directed to dispose of M.C.No.88 of 2012 as expeditiously as possible, preferably, within a period of three (03) months from the date of receipt of a copy of the order. With the above direction, the Criminal Revision Case is disposed of.

Miscellaneous petitions, if any, pending, shall stands closed.
