This Criminal Petition is filed under Sections 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short 'BNSS') by the petitioner/Accused No.6 seeking enlargement on bail in connection with Crime No.2556 of 2025 of Gachibowli Police Station, Cyberabad Commissionerate. The offences alleged against the petitioner are under Sections 8(c) read with 20(b)(ii)(C) of the NDPS Act, 22(c), 27 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short 'NDPS Act').

The case of the prosecution is that on 03.11.2025, Police received reliable information and thereby conducted a raid, in which they found the accused with 30 gms of MDMA. Basing on the same, the seized contraband was confiscated and a case was registered against the petitioner. 3.
Heard Sri S. Viplav Simha Reddy, learned counsel appearing for the petitioner and Sri D. Arun Kumar, learned Additional Public Prosecutor appearing for the respondentState. 4.
The contention of learned counsel for the petitioner is that the petitioner is innocent of the said allegation and the allegation against the petitioner is that on 03.11.2025, while accused No.1 was in his 201 room, his regular customer namely Lokesh Reddy, the petitioner herein, came to his room and he handed over 2.9 gms of MDMA. In the meantime, Police officials raided the room and his customer admitted the guilt of the offences, which shows that the alleged contraband with the petitioner was only 1.29 gms of MDMA, which is intermediate quantity. As such, he requested the Court to grant regular bail.

On the other hand, the learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the petitioner, contending that the alleged contraband seized from the possession of the accused is liable as 30 gms of MDMA, which is commercial quantity. As such, he requested the Court to dismiss the bail petition. 6.
Considering the submissions made by both the learned counsel and upon a perusal of the material available on record, the petitioner, arrayed as accused No.6, the allegation against the petitioner is that he went to the hotel to purchase MDMA from accused No.1. According to the prosecution, the case of the petitioner herein is that he purchased 1.29 gms of MDMA from the other accused. Therefore, the deceased from this petitioner is shown as 1.29 gms. It is pertinent to note that the seized contraband is an intermediate quantity and he is in jail from 04.11.2025. Hence, considering the overall facts and circumstances of the case, including the nature of the allegations levelled against the petitioner, the stage of investigation, and the duration of incarceration, this Court finds it appropriate to grant bail to the petitioner-accused No.6, subject to the following conditions:

The petitioner-accused No.6 shall execute a personal bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties for a like sum each to the satisfaction of the learned II Additional Junior Civil Judge-cum-X Judicial Magistrate of First Class, Ranga Reddy District, Cyberabad.
ii.
The petitioner-accused No.6 shall appear before the SHO concerned at 11:00 a.m., on every Monday for a period of eight (8) week or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required. iii.
The petitioner-accused No.6 shall abide by the conditions stipulated in Section 437(3) of Cr.P.C. (presently, Section 480(3) of the BNSS).

Accordingly, the Criminal petition is allowed. Miscellaneous petitions, if any, pending shall stand closed.
