THE HON'BLE SRI JUSTICE S.V. BHATT WRIT PETITION No.42311 of 2015 ORDER:
The dispute canvassed in the writ petition is a literal panchayat to be resolved by District Panchayat Officer.
The writ prayer is misconceived and the mere assertions by respondents without taking recourse to the provisions of Panchyat Raj Act an equally unmeaning. This Court is not proposing to examine the merits. The statements of the counsel appearing for the parties, namely; that the parties may be given liberty to represent their grievances to the District Panchyat Officer/second respondent by enclosing a copy of this order, within six weeks from today and thereafter, the second respondent considers the grievance of construction of Gram Panchayat Building its enjoyment and custody of Gram Panchyat Building and passes orders within a further period of six weeks from the date of receipt of representations are accepted and writ petition is disposed of accordingly. The second respondent if considers necessary gets local inspection undertaken by MPDO, examines the report and passes orders on the representation. No costs. 2.
