THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.12779 of 2015 ORDER:
This petition is filed under Section 482 Cr.P.C. to quash the proceedings in C.C.No.905 of 2014 on the file of the I Additional Chief Metropolitan Magistrate, Visakhapatnam. The learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the criminal petition with liberty to avail the remedies available to him under law including filing of petition for discharge. He further submitted that the petitioner has been working in Videocon Company in the State of Maharashtra. Therefore, his presence may be dispensed with before the trial Court on each and every date of adjournment.
There is no dispute with regard to the identity of the petitioner. Even if the presence of the petitioner is dispensed with, no prejudice will be caused to the second respondent.
Hence, the Criminal Petition is dismissed as withdrawn granting liberty as prayed for. The presence of the petitioner, who is accused No.2 in C.C.No.905 of 2014 on the file of the I Additional Chief Metropolitan Magistrate, Visakhapatnam, is hereby dispensed with on each and every date of adjournment. However, he shall appear before the trial Court as and when his presence is so required. Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
