THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION NO.23173 OF 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking to issue writ of mandamus declaring the inaction on the part of the respondents in taking appropriate action to protect the temple properties of Sri Prasanna Hanuman Devastanam temple, Picket Ram Nagar, Contonement, Secunderabad and not considering the joint representation, dated 30-06-2014 as illegal and arbitrary and consequently direct the respondents to take appropriate action against the encroachers of the temple properties.
2. Learned counsel for the petitioner submitted that the land in question belongs to the temple and the local people are making hectic efforts to encroach the temple land. He further submitted that the 2nd respondent is not taking any steps for removal of the encroachments. The only grievance of the petitioner is that the 2nd respondent is not disposing of the representation of the petitioner, dated 30-06-2014.
3. Having regard to the facts and circumstances of the case, the 2nd respondent herein is directed to dispose of the representation of the petitioner, dated 30-06-2014 in accordance with law as expeditiously as possible preferably within a period of two months from the date of receipt of a copy of this order.
4. Accordingly, the Writ Petition is disposed of. No order as to costs. Miscellaneous petitions, if any pending, in this Writ Petition shall stand closed.
