THE HONOURABLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.1125 of 2016 ORDER :

The Writ Petition was disposed of by order dated 10.08.2015 directing the fifth respondent-Mandal Praja Parishad Development Officer to forward the representations submitted by the petitioner on 30.03.2015 and 27.07.2015 to the District Panchayat Officer after the petitioner deposits an amount of Rs.25,000/-. According to the learned counsel for the petitioner, the petitioner deposited the amount on 22.08.2015. The District Panchayat Officer was directed to examine the representations based on the remarks offered by the fifth respondent-Mandal Praja Parishad Development Officer and to pass orders.

According to the counter-affidavit, the fifth respondentMandal Praja Parishad Development Officer forwarded the representations along with his remarks vide his representation dated 26.08.2015. Thus, the fifth respondent-Mandal Praja Parishad Development Officer has complied with the directions issued by this Court within the time granted to him. The District Panchayat Officer passed the orders in his proceedings dated 21.07.2016. As seen from the order of this Court, no time limit is prescribed for passing orders. Therefore, it cannot be said that the District Panchayat Officer committed contempt of the order of this Court. However, the Court expresses displeasure in taking such a long time for the District Panchayat Officer to pass orders when he received a report from the fifth respondent-Mandal Praja Parishad Development Officer on 26.08.2015 and warns him to be more careful in complying with the orders of the Court in future.

Accordingly, the Contempt Case is disposed of. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this Contempt Case shall stand closed.
