Assailing the action of the respondents in tampering the revenue records in respect of the agricultural land admeasuring Ac.2.20 cents comprised in Sy.No.59/1 of Bommaluru Khandriga village, Bapulapadu mandal, Krishna
District by changing the nature of land from 'Zeroyati' to 'Government land' without issuing any notice and affording an opportunity of being heard to the petitioner, this Writ Petition is filed.
It is the case of the petitioner that he is the absolute owner and possessor of the aforementioned agricultural land and that the said land is his self acquired property. When the petitioner intends to alienate the said property, he obtained certified copies of Adangal, FMB etc., in respect of the land in question and on verification of the same, he came to know that the said agricultural land was classified as 'government land'. It is the further case of the petitioner that in the said revenue records, the subject land was assessed as 'government land' as against 'Zeroyati' and in the columns of pattadar & Possessor, name of Garikapati Laxamaiah was recorded as against his name, i.e. Sikha Sesha Ratnam. It is submitted that the petitioner has not aware of these developments and on coming to know the same, she got issued legal notice dated 18.01.2014 to the respondents setting out all these facts and sought for rectification of the records. Despite the same, there is no response from the respondents. Hence the present Writ petition.
Heard learned Counsel for the petitioner and learned Government Pleader appearing for the respondents.
The learned Counsel for the petitioner fairly submits that he would advise his client to avail appropriate legal remedies as available under the provisions of Records of Rights in land and Pattadar Passbooks Act, 1971, particularly in view of Section 9 thereof by approaching the revenue authorities with necessary application/revision petition and supporting material gathered or that may be gathered from the office of the Tahsildar, fourth respondent herein. In view of the aforesaid submission of the learned Counsel for the petitioner, I deem it appropriate to dispose of the Writ petition directing the second respondent to consider and dispose of the revision petition that may be filed by the petitioner in respect of the land in question.
Subject to the above direction, the Writ Petition is disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No costs.
