HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 37983 of 2018 ORDER:
1) The present writ petition came to be filed seeking issuance of writ of mandamus questioning the inaction of the respondent authorities more particularly respondents 2 and 4 in not initiating any enquiry on the allegations made in the representations dated 22.09.2017, =24.10.2017, 10.11.2017, 11.12.2017 and 05.01.2017 in respect of fraud, illegal expenditure, irregularities and misappropriation of the third respondent temple funds, as illegal, arbitrary and against the principles of natural justice. 2) Though various grounds are raised in the writ petition, learned counsel for the petitioner restricts his prayer seeking a direction to the sixth respondent to consider the representation dated 22.09.2017.
3) Learned Government Pleader for Endowments would submit that that if the said application is still pending consideration, the authorities may be directed to consider the said representation in accordance with law.
4) Without going into the merits of the case and having regard to the facts and circumstances of the case, the present writ petition is disposed of, directing the sixth respondent to deal with the representation, dated 22.09.2017 made by the petitioner, in accordance with law, after hearing all the concerned.
5) Consequently, miscellaneous petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs.
