THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION NO.35167 of 2016 ORDER:

This Writ Petition is filed for the following relief:- ".....to pass an order, direction or writ more particularly in the nature of writ of Mandamus by duly declaring the action of the 2nd and 4th respondents in making illegal encroachments and structures made in CYBER TOWER, situated at survey number 64, Madhapur, Hyderabad in violation of the sanction plan, and the inaction of 2nd and 3rd respondent against the representations made by the petitioner as illegal, arbitrary and against the principles of natural justice and against the rules under GHMC Act, and consequently, direct the respondents to remove all illegal encroachments in the ground floor lobby CYBER TOWER, situated at survey number 64, Madhapur, Hyderabad, in the interest of justice and to pass such other and further orders as the Hon'ble Court may deem fit and proper in the circumstances of the case."

Learned Standing Counsel, Sri L. Prabhakar Reddy appeared on behalf of 2nd respondent-Telangana State Industrial Infrastructure Corporation and learned Standing Counsel, Sri Sampath Prabhakar Reddy, represented on behalf of 3rd respondent-Greater Hyderabad Municipal Corporation.

When the matter is taken up for hearing Sri P. Rama Sharana Sharma, learned counsel for the petitioner seeks permission of this Court to withdraw the Writ Petition with a liberty to work out the alternative remedies available to the petitioner. Recording the said submission, this writ petition is dismissed as withdrawn giving liberty to the petitioner as prayed for. Consequently, miscellaneous petitions, if any pending in this Writ Petition, shall also stand dismissed. No costs. _____________________________ CHALLA KODANDA RAM, J.
