- 2 - THE HONOURABLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.2708 of 2018 ORDER :

WP.No.19861 of 2018 was disposed of directing the respondents to conclude the disciplinary proceedings initiated pursuant to memo dated 09-09-2016 within two months from the date of receipt of a copy of order. The Court further directed that in the event of not concluding disciplinary proceedings within the time granted, they should consider the petitioner for promotion without reference to charge memo dated 09-09-2016. Alleging violation of the said direction, this contempt case is filed.

In the counter affidavit, respondents submit that disciplinary proceedings are now concluded and the matter is pending at the stage of passing orders by the authority. It is further stated that though there is one post vacant, no promotions are taken-up and no junior to the petitioner is promoted. There was direction to consider the petitioner for promotion without reference to charge memo and such consideration can be only after promotions are taken-up. The said assertion of the respondents is not denied by the petitioner. Unless promotions are effected ignoring the petitioner, it cannot be said that directions of this Court are violated, much less, willful and deliberate warranting initiation of contempt proceedings.
