HON'BLE SRI JUSTICE V.RAMASUBRAMANIAN AND HON'BLE SRI JUSTICE G.SHYAM PRASAD Writ Petition No.16227 of 2016 Order: (per V.Ramasubramanian, J.) The petitioners have come up with the above writ petition challenging the dismissal of their original applications by the Andhra Pradesh Administrative Tribunal.
2. Heard Mr. M.Venkat Ram Reddy, learned counsel for the petitioners and the learned Special Government Pleader, representing the learned Additional Advocate General for the State of Telangana.
3. The petitioners went before the Tribunal challenging a notification for recruitment of Agricultural Extension Officers Grade-II, on the ground of not including B.Sc (Vocational) Seed Technology as one of the eligible qualifications in the rules and notification. The Tribunal dismissed the applications on the ground that the statutory rules issued in G.O.Ms.No.167, dated 17-4-1997, are not under challenge and so long as the statutory rules are in force, the notifications for recruitment should follow the same.
4. We do not find anything wrong with the order of the Tribunal. A notification for recruitment should naturally be in accordance with the statutory rules. Therefore, we have no justification to interfere with the order of the Tribunal.
5. However, when a fresh recruitment is sought to be made, it may be open to the petitioners even to challenge the rules. With the above liberty, the writ petition is dismissed as infructuous. The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs. ___________________________ V.RAMASUBRAMANIAN, J.
