Mohd Vaseem v. The State Of Telangana
THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.NO.8184 OF 2016
O R D E R
This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in F.I.R.NO.299/2016 on the file of Women Police Station, D.D., Hyderabad registered against the petitioner, for the offence punishable under Sections 498-A of IPC and Sections 4 and 6 of Dowry Prohibition Act.
Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.
A perusal of the complaint reveals that specific allegations were made against the petitioner. This is a matter, which requires investigation by the police. The truth or otherwise of the allegations can only be decided during the course of investigation or trial. I see no ground to interdict the investigation at this stage and quash the first information report. In the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the criminal petition is disposed of, directing the investigating agency to proceed with the investigation. However, for a period of two weeks from today, the petitioner shall not be arrested.
Miscellaneous petitions pending if any, shall stand closed. No costs. ------------------------------ M.S.K.JAISWAL,J DATE:15.06.2016 AVS Note: Issue C.C. by tomorrow.
