THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.11416 of 2015 ORDER:

1. This writ petition is filed seeking to declare the action of the respondents in not treating the petitioner as regular employee as illegal and arbitrary, and consequently, to direct them to treat the petitioner as regular employee by duly extending regular scale of pay with effect from the date of her appointment.

2. The husband of the petitioner expired on 3.10.2005 while he was working as attender in Sri Kasi Visweswara Swamy Temple, Anakapalli. After his death, the petitioner made a representation to the respondents to consider her case for appointment on compassionate grounds. The 2nd respondent issued orders dated 22.9.2006 granting permission for appointment of the petitioner on compassionate grounds. Accordingly, she was appointed as Sweeper and posted at Bhogalingeswara Swamy Temple, Anakapalli, Visakhapatnam District. But the respondents are paying consolidated pay instead of regular pay attached to her post. The petitioner made a representation dated 11.12.2014 to the 2nd respondent through proper channel requesting him to consider her case for extending regular time scale of pay. But, the 2nd respondent has not passed any orders so far. Hence, the petitioner approached this Court.

3. Heard and perused the material available on record.

4. The main grievance of the petitioner is that she was appointed on compassionate grounds as sweeper in the year 2006, but the consolidated pay is being paid to her, and her representation for regular pay has not been considered so far.

5. Considering the facts and circumstances of the case and the grievance of the petitioner, the 2nd respondent is directed to dispose of the representation made by the petitioner, dated 11.12.2014, within a period of three months from the date of

receipt of a copy of this order. No order as to costs. The miscellaneous petitions pending, if any, shall stand closed.
