HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.31126 OF 2016 ORDER:

The case of the petitioner is that when he intend to sell the land admeasuring 233.33 square yards in Survey No.211-2 & 213/4C of Kammapalli Village, Ward No.4, East Kothapeta Street, Madanapalle, Chittoor District, he approached the 3rd respondent and presented the documents by paying all the necessary fee and that the 3rd respondent without processing and registering the same kept the documents pending by allotting numbers as P.244/16, P.245/16. Thereafter, when the petitioner made enquiry, he came to know that the 4th respondent issued letter vide proceedings in Roc.No.1498/E1/2014, dated 03.09.2016 to the 3rd respondent stating that the subject property belongs to the Municipality and to cancel the document No.5340/2016.

It is also the case of the petitioner is that the subject property is not included in the list of prohibited properties prepared as per G.O.Ms.No.215, dated 13.05.2016. Aggrieved by the action of the 3rd respondent in not releasing the documents presented by the petitioner i.e. P.244/16, P.245/16, present writ petition is filed. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

Having received the documents and assigned pending number, it is for the 3rd respondent either to register the documents if the same are in order as per the Stamps and Registration Act, or record reasons if he wants to refuse

registration of the said documents as per Section 71 of the Registration Act. If the property sought to be registered is not in prohibited list prepared under Section 22-A of the Registration Act, the 3rd respondent has to register the documents and release the same.

Accordingly, the writ petition is disposed of. No order as to costs.

As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed. __________________________ A.RAJASHEKER REDDY, J 17.09.2016 tk
