Today, when the matter is taken up, written instructions furnished by the Sub-Inspector of Police, Ananthapuramu I Town Police Station, Ananthapuramu district dated 1.11.2018 are placed on record by the learned Government Pleader. The said instructions read as under: "It is submitted that there is a civil dispute between the petitioner and one Doddamaneni Mallatesh in respect of the land in q uestion, wherein the Tahsildar, Ananthapuramu vide L.Dis.No.B/1434/18 dated 4.9.2018 and L.Dis.No.B/1444/2018 dated 14.9.2018, 24.9.2018 & 6.10.2018, sought police protection to the Mandal Surveyor, Ananthapuramu to enable him to survey the land and fix the boundaries. Accordingly, the 3rd respondent herein has provided police protection to the Mandal Surveyor, Ananthapuramu on 5.9.2018, 15.9.2018, 25.9.2018 & 8.10.
2018 as sought for by the Tahsildar, Ananthapuramu after making GD entries to the said effect. It is further submitted that Cr.No.371/2018, dated 27.10.2018, u/s.323, 447, 506 r/w 34 IPC was registered on the file of the 3rd respondent police station, basing on the complaint of one Doddamaneni Mallatesh, against the petitioners 1 & 2 herein & others, wherein investigation is in progress by the Sub-Inspector of Police, Ananthapuramu I Town P.S. It is relevant to mention here that respondent police authorities have not received any complaint from the petitioners herein.
In view of the facts and circumstances stated above, all the allegations of the petitioner against the respondent police authorities about interfering into the possession of the petitioners in respect of the land admeasuring Ac.3-57 cents in Sy.No.301 situated at Navodaya Colony Road, Ananthapuramu and interfering in civil disputes by providing police aid, are absolutely false, baseless and hereby denied. In fact, the 3rd respondent has never interfered in the civil disputes of the petitioners nor provided police aid to one Doddamaneni Mallatesh at any point of time. As stated supra, on the written instructions of the Tahsildar, Ananthapuramu, the 3rd respondent provided police protection to the Mandal Surveyor, Ananthapuramu, after making GD entries to the
said effect. Therefore, all the allegations of the petitioner against the respondent police authorities are incorrect, untenable and hereby denied".
Having regard to the above, the writ petition disposed of by placing on record the above instructions. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. ______________ A.V.SESHA SAI, J Date: 1.11.2018 DA
