THE HON'BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON'BLE SRI JUSTICE A. SHANKAR NARAYANA WRIT PETITION No.36784 OF 2015 ORDER: (Per Hon'ble Sri Justice R. Subhash Reddy) This Writ Petition is filed questioning the order, dated 05.08.2015, passed in C.C.No.138 of 2014 by the District Consumer Forum, Kurnool, in exercise of powers conferred under the provisions of Consumer Protection Act, 1986.

Under the statute, as against the order of the District Forum, there is a remedy of appeal to the State Commission. In fact, in this case, petitioner has already filed such appeal and when the same is returned with some objections, without representing the matter there, he has filed the present Writ Petition.

In view of the remedy of appeal provided under the statute and more so, as the petitioner has already filed such appeal, we find no reason to entertain this Writ Petition.

Accordingly, the Writ Petition is dismissed granting liberty to the petitioner to represent and pursue the appeal filed before the State Commission. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. No costs.
