ORDER:

Petitioner questions the revisional order passed by the Joint Collector in ROR Revision Petition No.34/2014 dated 16.08.2014.

Though various contentions are raised by the learned counsel for the petitioner, in the impugned order it has been found by the Joint Collector as well as the Revenue Divisional Officer that the sale deed, under which the petitioner claims the land, does not support his claim for the survey number claimed by the petitioner and as such, unless the petitioner's sale deed is appropriately rectified, the title of the petitioner with respect to the land claimed cannot be accepted by the revenue authorities. It is also not in dispute that an injunction suit filed by the petitioner, dismissed by the trial Court, is now pending in appeal. Even otherwise, since the aforesaid defect in the sale deed regarding survey number exists, as on today, unless the petitioner gets the sale deed rectified by any process in accordance with law, the relief sought for by the petitioner cannot be granted. The order of the Joint Collector is confirmed.

Hence liberty is granted to the petitioner to take all such appropriate legal steps including seeking of sub-division of the land claimed by the petitioner, in accordance with law, as advised, the writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. ______________________ VILAS V. AFZULPURKAR, J September 2, 2015 DSK
