THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.24567 of 2015 ORDER:
This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:
"to issue Writ of Mandamus to declare the action of the 1st respondent in not taking decision on the report submitted by the 2nd respondent in his Rc.No.E4/4048/2007, dated 17-122014 as illegal and arbitrary and grant such other relief." Heard Sri V.V.L.N. Sarma, learned counsel for the petitioner and learned Government Pleader for Social Welfare for respondents, apart from perusing the material available before this Court.
According to the petitioners, they are the purchasers of plots either directly or from their vendors who have originally purchased from M/s.Mohammadia Cooperative Building Society Limited, Vijayawada, Krishna District by way of registered sale deeds. It is further averred in the writ affidavit that there was a dispute with regard to the land purchased by the said society, which went upto Hon'ble Apex Court. It is also stated that indicating all the factual aspects the 1st respondent - State Government issued G.O.Rt.No.134 Minorities Welfare (IDM) Department, dated 08-08-2013, directing the A.P. State Wakf Board, Hyderabad, the Agriculture and Co-operative Department, the Revenue Department and the District Collector, Krishna District - 2nd respondent herein to take necessary further action in
the matter.
It is the further case of the petitioner herein that the District Collector, Krishna District - 2nd respondent herein submitted a final report to the State Government vide proceedings Rc.No.E4/4048/2007, dated 17-12-2014 and a copy of the said report is placed on record along with the writ petition as material paper. The sum and substance of the grievance of the petitioner herein is that no further action has been taken by the State Government pursuant to the said report submitted by the District Collector on 17-12-2014.
Taking into consideration the totality of the circumstances and the nature of controversy, this Court deems it appropriate to dispose of the present writ petition by directing the first respondent herein to take appropriate action pursuant to the report submitted by the 2nd respondent vide proceedings, dated 17-12-2014. For the aforesaid reasons, the writ petition is disposed of, without expressing any opinion on the merits and demerits of the issue, directing the 1st respondent - State Government to take appropriate action pursuant to the report submitted by the District Collector - 2nd respondent herein vide proceedings, dated 17-122014 within a period of three (3) months from the date of receipt of a copy of this order. There shall be no order as to costs. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order.
