Heard learned counsel for the petitioner, Sri P.Kesava Rao, learned Standing Counsel for GHMC and learned Government Pleader for Municipal Administration and Urban Development. The present writ petition is filed with the following prayer: 'For the reasons stated in the accompanying affidavit, the petitioner prays that this Court may be pleased to issue writ or writs, order or orders more particularly in the nature of mandamus thereby declaring the inaction of the official respondents on the representation dated 19.05.2016, made by the petitioner, as illegal, arbitrary and against the principles of Greater Hyderabad Municipal Corporation Act and consequently direct the respondents to remove an illegal construction in and over building premises bearing Municipal No.8-2-293/82/HH/37/6, situated in Summit Apartment at Plot No.37, HUDA Height, Banjara Hills, GHMC Circle No. 103, Khairatabad, Hyderabad, made by the unofficial respondents and to pass such other order or orders that are deemed as fit and proper in the circumstances of the case.'
Though various grounds are raised, learned counsel for the petitioner restricts his prayer seeking a direction to the respondents to dispose of the representation dated 19.05.2016. Without going into merits of the case and having regard to the facts in issue, the present writ petition is disposed of directing the respondent-authorities to consider the representation dated 19.05.2016, made by the petitioner, bringing to their notice the illegal constructions made in and over building premises bearing Municipal No.8-2-293/82/HH/37/6, situated in Summit Apartment at Plot No.37,
HUDA Height, Banjara Hills, GHMC Circle No. 103, Khairatabad, Hyderabad, at the earliest, preferably within a period of three weeks from the date of receipt of a copy of this order, after hearing the petitioner and the affected parties.
