HON'BLE SRI JUSTICE P. KESHAVA RAO WRIT PETITION No.5159 of 2015 ORDER:
Heard the learned counsel for the petitioner. The prayer sought in the writ petition is as under: "... to issue a writ, direction or order especially in the nature of mandamus or any other appropriate writ, order or orders declaring that the action of 2nd respondent for recovery of loan amount barred by limitation through 3rd respondent as illegal and arbitrary, irrational, prejudicial, arbitrary, unfair, and against principles of natural justice and equity as the procedure of recovery results in deprivation of petitioner right of equality in violation of Article 14 of the Constitution of India."
After arguing the matter for sometime, on a query raised by this Court with regard to the limitation, learned counsel for the petitioner seeks permission of this Court to withdraw the writ petition with liberty to file a fresh writ petition as and when cause of action arises.
Acceding to the said request, the writ petition is dismissed as withdrawn. No costs.
Miscellaneous petitions, if any, shall also stand dismissed.
