THE HON'BLE SRI JUSTI CE A.V.SESHA SAI C.M.A.No.391 of 2015 ORDER:

On reference to the Lok Adalat, the Lok Adalat passed the following Award dated 13.8.2016.

"The above case between the parties having been referred for determination to the Lok Adalat and the parties having compromised the case case/matter, the following Award is passed in terms of the settlement.

1. Sri Akshay Kulkarni, Legal Officer, ICICI Lambard General Insurance Company Limited and Sri.Vikrama Chandra, learned counsel for the respondents/applicants and both the parties are present.

2. It is stated that both parties have amicably settled their dispute and in pursuance of the compromise between them, the applicants have agreed to receive a total compensation of Rs.4,84,395/- as against the awarded amount of Rs.3,90,348/- with accrued interest there on, if any.

3. It is stated that the entire amount has already deposited by the insurance company as per the award.

4. Accordingly, the award is passed for the above said amount of Rs.4,84,395/- with accrued interest thereon in favour of the applicants in full quittance of their claim against the insurance company and they shall be entitled to receive the same.

5. The respondent insurance company shall be entitled for refund of Rs.1,61,465/- with accrued interest thereon, if any.

6. In terms of the compromise arrived at between the parties, this case is disposed of.

7. The parties are informed that the court fee, if any, paid by any of them before lower court shall be refunded.

In view of the above, there shall be a Decree in accordance with the said Award. Accordingly, the CMA stands disposed of. As a sequel, the miscellaneous petitions, if any, shall stand closed. There shall be no order as to costs. ______________ A.V.SESHA SAI, J Date: 21.9.2016 DA
